SafeWaste Global Latch Product Warranty

Introduction

SafeWaste group companies, trading as SafeWaste Global, are the intellectual property owners of the SafeWaste Wheelie

Bin Lid Latch products (the “Products”). These Products are manufactured under license by approved third-party contract

manufacturers. Full disclosure regarding manufacturing origin is available upon request for any specific market.

1. Product Testing and Acceptance

The original purchaser must independently trial and test the Products to their own satisfaction before distributing them to end

users. This includes understanding the limitations of the Auto-Release function and ensuring suitability under expected

environmental and operational conditions.

2. Warranty Coverage

SafeWaste warrants that the Products are free from defects in design, manufacturing, and workmanship for a period of five

(5) years (“Warranty Period”) from the date of original purchase. If SafeWaste determines, to its reasonable satisfaction, that

a Product is defective within this Warranty Period, SafeWaste will, at its option: (i) Replace the defective Product; or (ii)

Refund the original purchase price. Replacement Products will be covered for the balance of the original Warranty Period

only.

3. Product Lifespan

While this warranty is limited to a five-year period, the SafeWaste Latch has been designed and engineered for a ten

(10)-year service life, aligning with the standard expected lifecycle of a wheelie bin when used in normal operating conditions.

4. Warranty Conditions

This warranty applies only where: (i) The Products are installed and used correctly on wheelie bins, in accordance with

SafeWaste’s approved installation procedures. (ii) The Products are used solely for their intended purpose. (iii) The Products

have not been altered, modified, or used in a manner inconsistent with SafeWaste’s recommendations.

5. Exclusions

This warranty does not cover damage, malfunction, or failure caused by: (i) Improper installation or incorrect use on wheelie

bins. (ii) Ultraviolet (UV) exposure beyond normally accepted environmental conditions. (iii) Natural disasters such as fire,

earthquake, or lightning. (iv) Animal interference, including chewing or clawing. (v) Chemical exposure, including contact with

chlorine, solvents, acids, or other corrosive substances. (vi) Negligence, misuse, vandalism, or other external influences,

whether intentional or accidental.

6. Claims Process

SafeWaste shall not be liable for any claim unless: (i) SafeWaste is notified in writing within thirty (30) days of any occurrence

that may give rise to a claim. (ii) The original purchaser obtains written authorization from SafeWaste before altering the use,

environment, or operating conditions of the Products (for example, changes to bin contents or bin dimensions). (iii)

SafeWaste is permitted to inspect the allegedly defective Product and assess the cause of the issue.

7. Limitation of Liability

SafeWaste’s liability under this warranty is strictly limited to the replacement or refund of defective Products as stated above.

SafeWaste shall not be liable for incidental, consequential, or indirect damages, including but not limited to loss of use,

business interruption, or loss of profits, except as required by law. No employee, agent, or representative of SafeWaste has

authority to modify or extend this warranty beyond what is expressly stated herein.
